@jemand: the voluntary self control is as it's name says voluntary and a self control. It has no jurisdiction, it's not part of the executive and has no legislative power. .Most of the channels obey to rules this group is propagating, but that is just to be on the safe side and stay away from conflicts with the real authorities. And as there is no proof of a conflict with authorities, and as I don’t remember the voluntary self control crying foul about ETVs programming, I would also consider the reason for the change to be somewhere else.  I posted something about that in this thread [hidden link - please register]

The law in itself isn't explicit about what to show or not to show. But there's something called "freiwiliige Selbstkontrolle" - voluntary self control in Germany and an unspoken threat in Austria - especially after the hardcore action on TV6. The §32 is free for interpretation. If they are out to get someone, they can get them. And there are several quotes by controlers of what they would tolerate and what they won't - from the time when TV6 went down.

Hence the "erect penis" and "spread legs". It's in fact pretty similiar to the German laws.

My hottest vids from this year of Safo, Tia, Jaya et. al. always told me that there was no change of laws.

There  was just a change of rules of ETV. Nothing more.

A change of  "rules" means just another business model. Or how to save money.

Barbies are much cheaper than full stripper like Jaya, Safo or Tia. ETV just can't afford 50 models or more stripping 24/7. So the best way to save money e.g. is trying to sell the soft girls as hot ones. That's just their business. Bad business in my eyes. Therefore the boycott must go on.

Good one elmo & HvB :-) And indeed an interesting discussion. I prersonally believe in the theory from DB: that ETV 1 is transmitted on different cable stations (Germany and other countries) at night, forcing ETV to censor the shows even more at primetime than during the day.

The aim of ETV is unfortubately expanding instead of focusing on good erotic content. Mass instead of quality.

the whole time I have been watching ETV (approx 18 months) the company has been broadcast from ***** with an Austrian licence.

the regulations in Austria did change after the TV6 Boris and Steffi performances.
I didn't see them but have read that this is the case.

after the threshhold 22.00 in most european countries 00.00 in others the content is allowed to be more sexually explicit or violent with the usual caution for minors not suitable for under 16 or 18 as the case may be.

because both Astra and Hotbird have such a large footprint these two threshholds  cover at least 4 time zones i.e 4 hours - that complicates the situation.

it has been noticed by me when the models are left to themselves more. the situation on ETV2, the nightsolo spot and early morning shows (no or little regie the content can be more explicit, then the distance from the camera dictates the situation.

of course there will always be goof ups - followed by a warning or a fine imposed
by the so called watchdogs.

the consequence of this is that the models when naked, have to raise their leading leg to an uncomfortable posture similar to a bird sleeping to avoid camera surveillance. from now on I shall refer to this as the parrot posture.

The interesting paragraph for this discussion is §32. and as you can see, the last change to this paragraph was in 2004 (article 4 was included just to make live a little bit harder for Peter Stolz, the owner of TV 6)..

So there are no changes which would explain the change in the ETV-shows (the changed law is just another lie …).
Of course there (or in any other law) is nothing said about erected penises ore spread legs, just some diffuse blabla.
So what is allowed and what isn’t. A good question, but hard to answer. Obviously the shows of late 2006/early 2007 were in accordance with the law. Otherwise you would find something about this here (under Rechtsaufsicht):

As you can see, you can see nothing.

So there was no change in the law, there was no problem with crossing the limits given by the law and there was no problem with the authorities.
So why did the change the rules?

What you are actually saying is what is prevalent for most law-abiding countries when it comes down to live tv. A regulator can always preview something recorded but can only react after the event with live tv and usually after some complaint.

And art will always be looked on differently.

As for the E2 difference, I will post the clip I have in mind later today. But this is not, as far as I am aware, a one-off

@DB: I would have to do a whole lot of searching to turn up the particular law concerning free to air channels. I never bothered with that, since the legislation is pretty clear. Apart from the usual codes of conduct (no racism, offensive material, etc.), nudity is allowed.

But it's not allowed to show genitals. There's a difference being made between male and female genitals. It's only forbidden to show an erect penis, but it strictly forbidden for women to spread their legs. And that's where it gets totally confusing, since these laws aim at so called pornographic material. TV shows and programs like ETV or the late TV6 fall under that category, have to follow that law to the letter, since the legislator considers them aiming at arousal (which isn't that wrong anyway). But that doesn't apply to art or art films. Art is free.

I remember well, that a portrait of the Austrian performance artist Elke Krystufek was aired on ORF. And if you know the trademark of Krystufek - using mostly her own body as a means to express her art - you can imagine the content of that protrait. Also a film like "La belle noiseuse" where Emmanuelle Beart is showing most every part of her body is freely aired on the public channels. Same goes for some theatrical performances being broadcasted. Once again, it's art. The only restriction is, that programs like these are aired after 10pm with a parental guidance advice.

But I'm totally at a loss about your observations concerning the day and ETV2. I never tuned in during the daytime and I can't watch ETV2, since I don't have hotbird. So, unless only the nudity is more frequent and they still don't show any genitals, I can't possibly explain the difference.

It's the mod saying, that they aren't allowed to show pussy anymore, what has tipped me in the direction of Austrian or German legislation.

Don't worry about language. I have the means to get translations.

But I agree with you. There may well have been a backlash after the TV6 debacle and ETV are now paying the price for that.
