Novak Djokovic has been expelled from Australia : this was decided by the Federal Court, which met to examine the appeal presented by the lawyers of the number one in world tennis against the withdrawal of the visa. During the hearing, the three judges listened for several hours to the arguments of the Australian government, according to which the presence of Nole, not vaccinated against the Coronavirus, would represent a "health risk". The Serbian lawyers, on the other hand, defined the decision of the authorities as "irrational" and "unreasonable". Djokovic therefore losed his battle and will not be able to stay in the country to defend his title at the Australian Open. "The court's decision is that the request be rejected with the legal costs to be borne by the tennis player," reads the ruling. To take his place in the first round of the tournament, against Serbian Miomir Kecmanovic, will be a lucky-loser : the 28-year-old Italian Salvatore Caruso.

Gauff (3) 3-6, 6-2, 7-5 Novak Djokovic faces deportation again after the Australian government revoked his visa for a second time, the latest twist in the ongoing saga over whether the No. 1-ranked tennis player will be allowed to compete in the Australian Open despite being unvaccinated for COVID-19. Immigration Minister Alex Hawke said Friday that he used his ministerial discretion to cancel the 34-year-old Serb's visa on public interest grounds, just three days before play begins at the Australian Open, where Djokovic has won a record nine of his 20 Grand Slam titles. Three hours later, Djokovic's lawyers began their appeal against the visa cancellation in an after-hours hearing at the Federal Circuit and Family Court. The same judge, Anthony Kelly, ruled in favor of Djokovic earlier this week on procedural grounds after his visa was first canceled when he landed at a Melbourne airport. Djokovic's lawyer Nick Wood told Kelly he hoped that an appeal will be heard Sunday and that Djokovic would have his visa returned in time for him to play Monday, when the top half of the draw is set to compete. Djokovic remains free Friday night but would effectively return to immigration detention when he meets with Australian Border Force officials at 8 a.m. Saturday (4 p.m. ET Friday). He would spend the morning at his lawyers' offices under Border Force guard and return to hotel detention Saturday afternoon. Deportation from Australia can lead to a three-year ban from the country, although that may be waived, depending on the circumstances. Hawke said he canceled the visa on "health and good order grounds, on the basis that it was in the public interest to do so." His statement added that Prime Minister Scott Morrison's government "is firmly committed to protecting Australia's borders, particularly in relation to the COVID-19 pandemic". Djokovic's main ground of appeal against Hawke's decision was that it was not based on the health risk that the tennis champion might pose by not being vaccinated but on how he might be perceived by anti-vaxxers. |

Simona Halep ROU 2.791 points Novak Djokovic has won a court battle to stay in Australia to contest the Australian Open despite being unvaccinated against COVID-19, but the government has threatened to cancel his visa for a second time. Judge Anthony Kelly has quashed the visa cancellation, and ordered the Australian Government to pay legal costs and release Djokovic from detention within half an hour as he delivered his verdict at 6.16am GMT. Government counsel Christopher Tran notified the court that the Minister for Immigration, Citizenship, Migrant Services and Multicultural Affairs - not the minister who made the original visa cancellation - will now consider whether to exercise a personal power of cancellation of Djokovic's visa. Shortly after the verdict, a transcript of Djokovic's interview with Border Force last week was released in which the world number one stated : "I am not vaccinated". The Australian Open starts on Monday, January 17, with the draw taking place on Thursday, January 13. |

But Djokovic will likely challenge the order in Victoria’s courts. The world number one touched down on an Emirates flight from Dubai into Melbourne shortly after 11pm Wednesday night AEST. His father Srdjan reportedly told a Serbian radio station that his son was "isolated in a room" at the airport without his entourage and was being held under police guard. Srdjan later released an explosive statement to Serbian media : "I have no idea what’s going on, they’re holding my son captive for five hours", he said. "This is not a fight for the libertarian world, this is not just a fight for Novak, but a fight for the whole world! If they don’t let him go in half an hour, we will gather on the street, this is a fight for everybody". Even Serbian president Aleksandar Vucic became involved, calling Djokovic and providing an update via an Instagram post : "Just got off the phone with Novak. I told our Novak that the whole of Serbia is with him, and that our authorities are taking all measures to stop the harassment of the best tennis player in the world in the shortest possible period", Vucic said, "In accordance with all the norms of international public law, Serbia will fight for Novak Djokovic, for justice and truth. Otherwise, Novak is strong, as we all know him". Djokovic’s appeal against his visa cancellation has been adjourned until Monday, with the Serb to remain in Melbourne quarantine until then. |
