Actually, irrespective of broadcasting licences, I believe there are other laws that govern what can be considered to be hard-core pornography to be deliberatley shown FTA. TV6 tried it and failed.

I do not know the story about TV6 and tax evasion. Maybe Peter went down for that but surely they were un-connected.

My reading of the TV6 sitaution was different. There was a loop-hole in the broadcasting law that allowed FTA hard-core which they exploited. However they also flouted an accepted principle that children should always be protected and they broadcast at an hour when children could watch. That, as far as I know, is why they were forced to encrypt on Astra. Then the loop-hole was closed.

Of course, it would not be in Premiere's commercial interest to have a channel broadcast FTA when they broadcast encrypted pay-tv and there could have been a complaint.

But TV6 did not learn their lesson and there was that infamous 18 hours of broadasting on their one and only day on Hotbird.

@Hopeing Bull. Hipsat is not a satellite that is normally picked up within the transmission area of Astra and Hotbird. And more to the point, I believe they broadcast the hotter content at an hour when children are asleep not when they come home from school.

@ Mauro in the western world, it is sometimes very difficult to convict wrongdoers,
i.e TV6 so the suspect often gets zapped for tax evasion to take them out of circulation. I read that after this episode the Austrian governing body tightened up the broadcasting restrictions to avoid a recurrence.

There is no proof that Premiere has intervened. Why should they have done it? There were hundreds of other channels, esp. Hispasat, which sent hardcore.

You're definitely right that what Hot Chili is broadcasting in the last weeks during the day is bypassing FTA broadcasting licenses. And as I already mentioned in another thread "Lady 69" is NOT a sexy or exciting girl. But Shakira last weekend was.

TV6 lost it's license mainly because of defraudation of tax. The content of the program was not the reason, but it was censored after Germany and especially Premiere got nervous that Austrian TV is broadcasting porn for free.
