it is a bit strange as there are harder channels on TV then them.

I also called Vikki Thomas on EliteTV and she confirmed that they have been taken off the air for breaching too many rules, so they're definitely gone.

I hope the women go somewhere good. Danni and both Lucys need to be on the same channel. That's a given.

whats the link between Xcite and Xplicit? different web sites and web streams but noticed last night Xplicit appeared for a few minutes on the Xcite stream. all very confusing.

So we now have a name change to xcited tv with the days shows called xcite and the night ones called xplicit.

Answering your next question Dionne maybe improving, but thanks to a EX-FORUM MEMBER we decided to close her thread, and it will remain closed until some grow up Smile

Bangbabes are really pulling out the stops for a channel that's supposed to be dead. Sammie Pennington is doing a night show on Saturday as well. Now we just need to persuade Emma Spellar. Cool

Should be interesting tonight and saturday night as 2 of there day girls do 2 hours each, so 9pm - 11pm UK time.
Tonight its Fernanda Ferrari and saturday its Sammie Pennington.

And lets see if Sammie actual does a proper show this time.

Well it seems there taking notice of ofcom as now they have a second channel going again "Ch 915 aka Climax" i do wonder what they are playing at but i also wonder if they do?

Bang Media have now removed their transmissions from the S#y services listings TMTN1 TMTN2 and with good cause. Within the body of the revocation report from Ofcom they state that they are aware that the broadcaster is still transmitting a service via satellite in breach of the Broadcasting Act 1990 which is a criminal offence.

1.38 Indeed, Ofcom has evidence that the Licensees are continuing to breach the direction to cease broadcasting despite the Licensees representations that new compliance systems will be put in place and that those responsible for the lack of compliance in the past have been removed from their positions.

1.41 The Licensees have not responded to any other regulatory action and Ofcom considers that it must act promptly in accordance with its duties. Ofcom is therefore revoking all the licences held by the Licensees with immediate effect on the basis that they are no longer fit and proper to hold those licences. Should the Licensees continue to provide a relevant regulated television service they will be guilty of a criminal offence under section 13(1) of the 1990 Act.

Whilst Bang may have been playing with the regulator to see how far they could be pushed before invoking any serious penalties seems to have backfired in their face. Yes they have a substantial fine that remains unpaid for what ever reason, i hope it's because they are seeking judicial review of the contents board decision, but in all likelyness it's a complete refusal to pay and for Ofcom to pursue payment through the appropriate courts.

Ofcom themselves state that further financial penalties against Bang would not safeguard against further breaches.

1.37 The actions of the Licensees demonstrated that the imposition of financial penalties would have been highly unlikely to result in the Licensees ensuring compliance with the provisions of the Code in the future. The financial penalty of £157,250 which was imposed on the Licensees on 29 July 2010 was immediately followed by three further breaches of the Broadcasting Code and a further nine similar breaches of the BCAP Code have been recorded since the issue of the notice of intention to revoke on 2 November 2010. The penalty has therefore clearly failed to have the required deterrent effect. Indeed, the penalty remains unpaid and Ofcom is pursuing this as a separate matter. In Ofcom’s view, imposing further financial penalties under section 237 of the Act would therefore be unlikely to safeguard against further breaches, taking into account the conduct of the Licensees over this period, and would not therefore be an effective remedy.

Fine was imposed for continual breach of the Broadcasting Code, Administrative Law. Financial penalties where the dutyholder is subject to a variable fine, rather than a fixed penalty, and which are imposed by the regulator or enforcing authority without recourse to the courts. In the UK, monies generated by administrative fines generally go to the Exchequer rather than being reserved for local restitutive purposes or retained by the regulatory body and therefore Ofcom have a civic duty to pursue payment of this fine by whatever means.

In my opinion Bang should transfer their assets and liquidate the company.

Ofcom are now threatening the broadcaster with breach of the Broadcasting Act 1990, criminal law, a whole new ball game.

To be found guilty of a criminal offence increases the ante tremendously.

Depending on which court action is taken the broadcaster could face unlimitted fines or if the actions are against individuals loss of liberty (imprisonment), though unlikely. Hence why they have now closed down the two channels via S#y services.

I don't believe we have seen the last of this broadcaster, they may not return as Bang Media but through another limited company with oversea licenses.
