But back to Astra:

ETV cannot survive without Germany.

Calling from Germany costs 2 or 3 Euro and there is no time limit (except the phone provider, mine kicks me after 2 hours).
iirc costs a call from Italy 1.50 Euro and ends after 5 or 6 mins, nearly the same time limit for the UK.
5 or 6 mins is nearly a no-call. You can ask for your model, can say Hi and can ask a question and it's over.
E.g. asking Scarlet for Mashiaras favorite songs takes 4 mins.
Sending a SMS from Germany costs 5 Euro and a VIP 10 Euro.
These bring more money for etv than calling the italian mod for a VIP.
iirc are more than 12.000.000 Astra viewer in Germany.

So either there is etv on Astra or there is no etv.

Either they are compelled to change the concept or they have to close down.
Or maybe they reduce the number of models and try to survive only on hotbird.
I'm sure they are searching for a new way to make money when the phoneline source on astra is dry.

Basically, this article refers to a complaint of the German "Kommission für Jugendmedienschutz der Landesmedienanstalten" KJM (Commission for the Protection of Minors in the Media). This is the official press statement of the KJM of July 19, 2010 (sorry, again in German):

This is my unofficial translation of what I regard as the key paragraph:

"In a joint effort, the KJM and ASTRA acquired an agreement, which affects a total of almost 40 services regarded as problematic with respect to youth protection: The KJM and ASTRA declare therein, that no more contracts will be made with providers of free-to-air erotic content. ASTRA will let expire any existing services by the end of 2011."

This agreement was triggered primarily by complaints against so-called "erotic still-image channels", but the wording of the statement above doesn't seem to make a distinction between those and channels with a live program, like ETV. According to the article referred to by Tarl_Cabot, the erotic programs may live on as encrypted channels. However, it's easy to predict that this would spell the end for ETV.

Yes, exactly! It's the same mystery as with the "Sexy Sport Clips" on DSF/SPORT1 mentioned below by jost54. Music and sport channels aren't tagged as "erotic", so they've got many more degrees of freedom. This is one of the many cases in public life where double standards are applied.

Actually I would not miss most of the erotic channels, if they were shut down, because they are rather dull. However, ETV is something special in this genre, and it would be a pity if moronic bureaucrats would kill it in their pointless raving madness.

In my mind, the deal between Astra and the German KMJ concerns the erotic channels (static pictures) which broadcast around the clock. So etv should be unconcerned, because it doesn`t show naked people during the daytime and the nightshows are so soft that each censors would fall asleep.Big Grin

Like I already said - you'll always find someone who complains to the authorities, especially in Germany. In the past, I've been a member of the board of a private radio station, which was subject to some complaints about pornographic content. Those complaints usually originated from a registered association, whose members obviously dedicated all of their spare time to observing unwanted programs throughout for potential violations of the regulations. Although some of the complaints were really ridiculous, they were pursued with much diligence by the authorities, and this station was close to the edge every time.

So it doesn't really matter if the night shows on ETV are soft or not. It matters if someone wants to get rid of ETV, and in this case, ETV really is endangered.

Thanks for the correction - you're right. As far as I understand this legal mumbo-jumbo, the revised version of §32 is in effect since October 1, 2004.

The translation must be older as §32 (4) was added in 2004 to deal with TV6 and anyone else who will try the same.

Yes, that's the situation in Germany, as far as I know, but I don't know if it's the same in Austria. The authorities do in fact react to complaints, and you can bet that there always will be someone who complains about a 24h erotic channel like ETV. Some people don't have got more interesting things in life but to destroy something that other people enjoy.

I already commented on similar arguments below, and the assertion is not correct that ETV may broadcast anything between 23:00 and 06:00, because youth protection is not the only restriction that applies to erotic programs. Besides youth protection, the Austrian "Private Television Act" (PrTV-G) regulates the broadcasting of content that shows "pornography or unfounded brutality", as defined in §32 (1). In §32 (4), this act regulates the broadcasting of such content at ANY time of day. Please find my own unofficial translation below:

"In particular, TV programs in the sense of §32 (2), which confine themselves largely to the unreflected demonstration of sexual actions, or which contain program parts that are reduced to the demonstration of such content - as long as the broadcasting isn't already prohibited by §32 (1) - require encryption in any case."

So what §32 PrTV-G essentially says is:

- Content that shows pornography or unfounded brutality in a way that "may seriously impair" minors is PROHIBITED.
- Such content that "may affect" minors must NOT be broadcast during DAYTIME, while minors might have access to the TV.
- If the content isn't prohibited, but restricted in the sense above, it requires ENCRYPTION IN ANY CASE - that is, even at night.

Now add 1+1, and you will understand that ETV - as a free-to-air satellite broadcaster - must restrict its program even at night with respect to §32 PrTV-G. By the way, the full text of the PrTV-G in German language as of 2009 is available online. There's an unofficial English translation as well, but it's obviously from July 1, 2006, and hence not up to date. Especially the important §32 (4) is missing.

because the Freedom of Speech and Freedom of Press are rated so highly in the constitution, no gouvernment organisation would dare to actually censor a tv-channel. To solve this problem, they have formed a commission, which is supposed to be representing the population and which observes the media. If they decide, a show is of somehow inappropriate or obcene content according to the law, the tv-channel will be fined to some extent up to the revocation of the license. Propably they only react to specific complaints, so as long as nobody actually reported, what was going on at a certain time on etv, nobody really cared.

Still, nothing has ever been reported about a complaint that concearns the time between 23.00 and 06.00. What the do in this time is very much up to the management (within reason, of course).
