Dear ETV, a word from your special correspondent

This post is made on the assumption that the new nudity rules are the response of ruling by the French CSA on adult channels broadcasting on Hotbird.

I read the article, a translated link posted in an another forum here, and one or two things struck me. The specific warning was to Xtream. That channel was based in Panama, outside the EU, it can well be argued that the CSA, acting as the highest authority to 'police' Hotbird transmissions as within its rights to warn the channel.

But surely the situation with channels having broadcasting licences withing the EU, and being answerable in the first instance to their regulators, is different. As long as the regulations in that licence are not in contravention of EU law, the CSA is acting in contravention of the general principles of the EU in imposing its will in such circumstances.

In the last 12 months I have seen nothing on your channels which should provoke such a draconian attitude anyway.

So unless it really is your will to tone down the content completely before 23:00, I am sure you are exploring the legal situation. I only hope that such clarification does not come too late for you.
