HvB wrote:knowingly linking to illegal or infringing content is illegal. The same is true for allowing users to share links to illegal or infringing content on a webpage.
Not always a truth, the reality is a little bit more complicated. Could be a truth in many cases but it depends what kind of linking is used.

HvB wrote:So linking to infringing content on MU or RS is illegal.

Not a true.
If the linking to hostings servers was illegal, the websites like rlslog.net or any similar could never exist anymore and you can be sure that the newspapers would be full of articles about a court cases "company xx" versus "forum yy". But nothing like that happens.
Linking to RS or MU is not a deep or inline link, because the visitor who clicks the link is not refered directly to the infringing content, but is only refered to another webpage and then he needs to do many other steps/actions/clicks (another one or more link clicking, captcha text typing, sometimes even the registration is needed), before he can download the infringing content. Due to all of this another steps needed and another additional complications for the visitors, the linking to hosting servers is not considered to be a deep link and therefore using of this linking is not considered to be illegal.

HvB wrote:Mauro did a very good job on covering the video posters arse...

100% agree. If this forum wants to use deep and inline links for direct videos playing and the vidcaps previews in the posts, the admins need a permission for that and yes, Mauro did a great job in this matters and I am also thankful to him.
Although, I doubt he really has got the permissions from all of concerned. If someone is not protesting, it does not mean he is automatically giving a permission.

sorry for another OT (it's my last topic about this theme)

linking to RS, MU, Oron etc = surface link - not illegal
linking to Megavideo = deep link - illegal
linking to Imagebam etc = in-line link - illegal (btw, hundreds or maybe thousands of posts here on the forum contain in-line linking for copyrighted pictures)

HvB wrote:knowingly linking to illegal or infringing content is illegal. The same is true for allowing users to share links to illegal or infringing content on a webpage.
So linking to infringing content on MU or RS is illegal.
On the other hand linking and posting content of the fta shows in here is ok as lstv managed to get the agreement of etv for this, so it's no copyright infringement and therefore even deep linking and in-line linking is ok as it is happening with the agreement of the copyright holder. This agreement doesn't cover other sites or reposts of the same content on other websites and it also doesn't cover the non fta content (eg. any pay content etv may offer).
So any other site or forum offering any etv produced content is actually infringing on etvs copyright and the operators/owners/posters are liable for this. Note that it doesn't need etvs intervention to be liable. There are many lawers out there specialised on sending liability notices for infringing content (quite a lot of ebay users made their experiences with them when they used corporate logos in their offers ...).
Mauro did a very good job on covering the video posters arse when he was able to reach the consent of etv back in 2006 (iirc). Thanks guy.

I'm not Tarl, but that is a simplification that is not valid.

[Versteckter Link - Registrierung notwendig] (especially notice 18 and Article 3 §2). There is a lot more to find on EU directives on this topic ...
If someone has the time to look for links how this is handled in other countries, I would appreciate reading the articles.

Re: Off-Topic Discussion

@Tarl_Cabot
Why do you think I was in the bad mood on Sunday??
When I complain about the prohibition of some of the videos, I am writing it with my open mind, because I simply disagree. It's not because of my bad mood.

Copying a plain text with an url link is not a crime. That's not from my head, that's what the law says. This is a fact, which is by you "moderators" always and voluntary ignored and I (as a member who wants only the best for this forum) can't accept it.

Do not get me wrong, if some girl is asking moderators for removing her videos (due to some her private reasons), I have no problem with that. I am also a human beeing and I can undertsand that. But if you are asked for the same thing by any TV boss, because he thinks that this forum is breaking his business, then I need to start to behave like a businessman too. I never said this forum is bad. You all made a huge job here and I like to be here. It's nice to read the posts from "some" members and it's also nice to have a possibility to download a videos. Unfortunately, with all these new 'social' features the forum is slightly changing and the possibility to find a new videos here is almost disappearing. On the one side I see every day dozens of nonsence posts from an oral exhibicionists who can't sleep to write another post to be the first who reaches the 5000th post together with atleast 20th level of popularity and on the other side, when I look in the video threads, it's almost empty.

In the past I wanted to improve this poor video situation, so I started to post my own videos here (you started the same if I remeber well) . Unfortunatelly I do not have a time to continue with my videos anymore. But I am always glad if some new videomaker appears and it's quite sad to see if some videomaker is ready to post some of his stuff and you stop him! I disagree with that and I will be always complaining about it, no matter if my mood is good or bad.

Remember, I do not write this to hurt some moderator's ego, I write it because I want you to think about it. We are both on the same boat.

Sorry for the OT, move it on the place where it should be, I am not sure where it is.
